Every day, people all over the England and Wales, are being targeted by fraudsters who are intent on taking their hard-earned money.
Scams are becoming increasingly sophisticated, but banks are required to take steps to help protect their customers and detect fraudulent activity to prevent fraudsters from being successful.
Fraud has a devastating impact upon victims and the financial impact can ruin lives.
In many situations, banks are required to refund victims, but they commonly fail to do so when the victim approaches them.
At Johnson and Boon Solicitors, we help victims of fraud recover their funds by submitting a claim to their bank and then subsequently following it up with a complaint to the Financial Ombudsman Service if the bank fails to comply with their obligations.

The Process
This is the No Win No Fee process that we will follow:
You can then decide whether or not you wish to consider litigation through the Courts. Litigation is however not covered by our No Win No Fee service and so you will need to consider the various risks at that stage before you proceed further. Most cases do however resolve at stages two or three above.
Over £230 million has been lost to investment scams over the last two years. According to UK Finance, in the first half of 2021 alone over £107 million was lost to this type of fraud. Investment scammers are changing their tactics regularly, but the frauds they perpetrate usually have a similar theme.
Criminals stole £580 million through unauthorised and authorised fraud in the first half of 2023. This was a two per cent decrease compared with the same period in 2022 and so whilst counter fraud measures seem to be having some impact, investment scammers are continuously changing their tactics and approach to deceive people out of the funds.
An investment scam involved the victim being persuaded or pressured into investing in something that did not exist.
If you believe you have been tricked in this way by a scammer, it may be that we can help you in recovering your money.
This often involves the victim receiving SMS messages or phone calls from a fraudster pretending to be a financial institution such as your bank. They will tell you that your funds are at risk and you need to move the funds into a safe account before they become subject to fraud. The unsuspecting victim is given no thinking time and often before they realise that all is not quite right, they have transferred funds into the so called ‘safe account’ and it is lost.
Other examples involve the fraudster posing as HMRC, the police, BT or another trusted institution. They contact you via telephone, SMS or email and attempt to convince you to send money to an account that they control. Once you comply with their request, they disappear with your funds.

This commonly occurs when your card is used without your permission after it being stolen or cloned. It can also occur if someone steals your mobile phone and uses it to send money to another account that they control.
This type of fraud involves the victim making a payment that they did not authorise which is different from when someone is tricked into making because they didn’t know it was a scam at the time they did it.

This type of scam commonly starts with the victim receiving an unsolicited message which offers a job opportunity.
This is will nearly always involve working from home, flexible hours and no previous experience. It can however come from the victim filling in an application for a job on a bogus website and that enquiry then being followed up by the fraudsters.
The job will usually involve the victim completing a set of tasks and they earn commission from each one. You will build up the commission until you receive a task which requires you to make a deposit before you can then earn a larger amount.
Sometimes, this happens a few times and the victim receives a small amount in return. That then builds into a larger deposit being made and that is then when the fraudster strikes and steals the funds.
In some instances, victims will be encouraged to take out a loan in order to fund a large deposit which is needed on the basis that the return will be worth it.
These scammers are persuasive, well set up and involve sophisticated approach. Victims are therefore confident that all seems well until it is too late.
A romance scam will build up over time by developing a relationship with the victim via online contact.
The victim can sometimes meet the fraudster on a dating site without knowing that they are using a fake profile.
Once the scammer has gained the trust of the victim, they then begin to start asking you to send money or gifts.
This then builds over time until the victim is being encouraged to send significant funds or regular small amounts which add up. There are sometimes occasions when the victim will release login details, passwords or account details which allow the scammer direct access to their funds.
This is usually a type of scam which causes a significant loss in a single act of interception.
A common example is when the victim is involved in a conveyancing transaction to buy a property. They will receive an email which they believe is from their solicitor and they will transfer their deposit into the account requested.
They then later realise that the email was not from their solicitor but a scammer pretending to be their solicitor and the deposit has gone to the fraudsters account.
These scams are complex, sophisticated and involve fraudsters looking for victims and waiting until the perfect time to strike.
Other examples include the fraudster submitting an invoice for other high value things such as building work.
